1. Mr. Tilak Ram Sharma, learned counsel holding the brief of Mr. Shailendra Nauriyal,
learned counsel for the petitioner.
2. Mr. Pradeep Hairiya, learned Standing Counsel for the State.
3. By the instant writ petition the petitioner is praying for the following reliefs: i. A writ, order or direction in the nature of certiorari quashing the impugned recommendation dated 09.01.2018 (Annexure no. 12) made by respondent no. 4 whereby the approval was accorded to re-fix the pay of the teacher who have been granted the benefit at Rs. 17140 (revised pay scale as per the recommendation of 6th pay commission) and further recommended that excess amount of the salary be recovered from those teacher and same be adjusted in the arrears of the VIIth pay commission. ii. A writ, order or direction in the nature of certiorari quashing the impugned letter dated 09.02.2018 (Annexure no. 13) issued by respondent no. 3 whereby the respondents no. 2 and 3 have directed their subordinate that ensure the implementation of the recommendation of the Committee (respondent no. 4) made in its meeting dated 09.01.2018.
4. It is contended by the learned counsel for the petitioner that the issue as raised in the instant writ petition is squarely covered by the judgment passed in WPSS No. 480 of 2018 ‘Sohan Lal Bhatt vs. State of Uttarakhand and Others’.
5. Mr. Pradeep Hairiya, learned Standing Counsel have not disputed this fact that the issue as raised in the instant writ petition is covered by the aforesaid judgment.
6. In view of the aforesaid submissions as advanced by the learned counsel for the parties, the instant writ petition is disposed of in terms of the judgment dated 18.02.2019 passed in WPSS
