Choudhury, learned counsel appearing for the petitioner. Also heard Mr. P. S. Lahkar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 528 of the BNSS,2023 in respect of the NDPS Case No. 43/2025 pending before the Court of the Learned Special Judge, Cachar, Silchar. 3. Mr. Lahkar, learned Additional Public Prosecutor for the State of Assam has Page No.# 2/2 pointed out that commercial quantity of narcotic drugs was ceased in this case and according to the Section 37 of the NDPS Act, this application need not be considered. 4. The petitioner submits that he has been shown as an absconder in the Charge Sheet and wants to contest the case. The petitioner submits that he may be given adequate opportunity to that effect. 5. I have considered the submissions made by the learned counsels for both sides. 6. Since the petitioner, namely, Rahid Hussain Laskar is interested in facing the trial, he deserves to be given adequate opportunity to that effect. 7. Therefore, his application is allowed. 8. The petitioner is directed to appear before the trial Court of the learned Special Judge, Cachar, Silchar by tomorrow i.e. on 21.11.2025 and on his appearance he shall be released on bail of Rs. 50,000/- (Rupees Fifty Thousand) with a surety of the like amount to the satisfaction of the Learned Special Judge, Cachar, Silchar. 9.
