GP FOR SERVICES I (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ, order or a direction, more particularly one in nature of Writ of Mandamus declaring the action of the respondents in not concluding the disciplinary proceedings even after nine and half years of its initiation in Charge Memo in Memo No.459/02 A6 Dated 10.05.2010 issued by the 2nd respondent against the petitioner for an allegation of 15 years old pertaining to the year 2004 as illegal, arbitrary, irrational and Policy of the Government in G.O.Ms.No.679GAD (Services-C) department dated 01.11.2008 stipulating 6 months for concluding the disciplinary proceedings and also contrary to the ratio of the Judgments of our Hon’ble Judiciary on the subject and consequently set aside the said Charge Memo in Memo 2 No.459/02 A6 Dated 10.05.2010 issued by the 2nd respondent as contrary to G.O.Ms.No.679GAD (Services-C) department dated 01.11.2008 and also contrary to the ratio of the Judgments of our Hon’ble Judiciary with a direction to release the full pension and pensionary benefits of the Petitioner forthwith as he was retired from service more than 9 years ago on 31.07.2010 and to pass …” 2. When the matter is taken up for hearing, Sri G.Venkata Krishnaiah, learned counsel for the petitioner would submit that the petition may be disposed of since the relief has become infructuous. 3. Recording the same, the Writ Petition is disposed of, since, the relief has become infructuous. No order as to Costs.
