Zequeson, learned counsel appearing for the petitioner. Issue notice, returnable within four weeks. Mr. Shyam Sharma, learned GA entered appearance and accepts notice on behalf of respondents No. 1 and 2 and Mrs. I. Bimola, learned counsel entered appearance and accepts notice on behalf of respondent No. 3, hence no formal notice is called for. I have heard at length the submission advanced by the learned senior counsel appearing for the petitioner with regard to the prayer for passing interim order. It has been submitted that a criminal case as well as a Department Enquiry have been initiated against the petitioner. According to the petitioner, no charge-sheet has been framed in connection with the criminal case, however, Articles of Charges has been framed in connection with the Departmental Enquiry initiated against him. Supp. IN. 1 SHOUGRAKPA M DEVANANDA SINGH Digitally signed by SHOUGRAKPAM DEVANANDA SINGH Date: 2025.09.24 15:19:49 +05'30' WP(C) No. 760 of 2025 Contd..,/- It has been submitted that the petitioner has already rendered about seven years’ regular service as MCS Grade – II and that he is eligible for consideration for promotion to the higher post of MCS Grade – I as provided under the relevant rules. The learned senior counsel further submitted that the authorities are initiating process for considering for giving promotion of the eligible candidates to the higher post of MCS Grade – I and that in the event the authorities did not consider the case of the petitioner because of the pending cases against him, the petitioner will suffer great injustice. The learned senior counsel, accordingly, prays for passing an interim order directing the authorities to consider the case of the petitioner along with other eligible candidates, if any Departmental Promotion Committee meeting is held for giving promotion to the post of MCS Grade – I. Mr. Shyam Sharma, learned GA appearing for the respondents seeks some time to get instruction from the authorities as to whether the petitioner is eligible for promotion to the higher post or not. After hearing the counsel appearing for the parties and on perusal of the record, this court is of the considered view that it will be in the interests of justice to pass the following interim order:- (i) In the event the authorities initiated the process for considering the cases of the eligible candidates for promotion to the post of MCS Grade – I in terms of the relevant rules and in case the petitioner is found to be eligible for such consideration, his case should be considered for such promotion along with other eligible candidates; -2- WP(C) No. 760 of 2025 Contd..,/- (ii) It is, however, made clear that since the Departmental Enquiry has already been initiated against the petitioner, the recommendation made by the Selection Committee in connection with the writ petitioner should be placed under the sealed cover as provided under the relevant rules. List this case again on 07-11-2025.
