1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.62/2025 registered at Police Station – Arjunda, District-Balod (C.G.) for the offences punishable under Section – 85 of BNS (Correspondence Section in IPS in 498-A).

As per Case of the prosecution, the present applicant is the complainant Vandana Sahu wife of Daniram Sahu the present applicant no. 01 lodged Report against the accused persons for harassing her in the name of bringing dowry against her husband and other relatives of her husband and upon the above allegations the concerned police station has registered the F.I.R against all the applicants.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that applicants have never tortured the complainant for demand of dowry in any manner. He also submits that parties are directed to remain present before the Mediation Center on 02.07.2025 for their compromise and also
directed the applicant to deposit Rs. 75,000/- with the Mediation Center of the High Court within 10 days but due to financial crises applicant failed to deposit the said amount, as a result of this Mediation failed. He also submits that investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.

4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, gravity of offence, also considering the fact that on 23.06.2025 parties are
directed to remain present before the Mediation Center on 02.07.2025 for their compromise and also directed the applicant to deposit Rs. 75,000/- with the Mediation Center of the High Court within 10 days but due to financial crises applicant failed to deposit the said amount, as a result of this Mediation failed as such, I am not inclined to grant anticipatory bail to the applicant No.1 Daniram Sahu but considering the age of other applicants, I am inclined to grant anticipatory bail to the applicants No.2 to 6.

Accordingly, the anticipatory bail application of the applicant– Daniram Sahu filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.62/2025 registered at Police Station – Arjunda, District-Balod (C.G.) for the offences punishable under Section – 85 of BNS (Correspondence Section in IPS in 498-A) is rejected and applicants No.2 to 6- Radheyshyam, Radhika Bai, Kusumlata, Ashok Kumar Sahu, Pukeshwar Nishad, filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.62/2025 registered at Police Station – Arjunda, District-Balod (C.G.) for the offences punishable under Section –
4 85 of BNS (Correspondence Section in IPS in 498-A) is allowed and it is directed that in the event of arrest of the applicants on executing a personal bond with one surety each in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant shall not involve themselves in any offence of similar nature in future. Sd/- (Ramesh Sinha)
