Order 19/08/2025
1. By way of filing this writ petition, a challenge has been led to the impugned order dated 07.07.2025 passed by the Board of Revenue (for short ‘the Board’), by which the prayer of the petitioner for passing interim order has been declined and the record of the Trial Court was summoned and the case
(2 of 2) [CW-12040/2025] was posted for arguments on the stay application on
26.08.2025.
2. Counsel submits that looking to the nature of dispute involved in the matter, interim order is required to be passed, but instead of entertaining the interim application submitted by the petitioner, the Board has posted the matter for
arguments on the stay application by summoning the record.
3. In the considered opinion of this Court, when the matter is subjudice before the Board for deciding the stay application and the record has been summoned and the next date posted before the Board is 26.08.2025, this Court is of the view that let the Board decide the stay application on the next date and if not decided on the next date, then on a fixed short date of one week or two, after hearing both sides.
4. With the aforesaid observations/directions, the instant writ petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
