District and Sessions Judge, Ramanagara arising out of Crime No.216/2016 registered by Tavarekere Police Station, Ramanagara District, for the offences punishable under Sections 143, 147, 148, 448, 427, 307, 302, 114 R/w 149 of IPC is before this Court seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. Learned counsel for the petitioner submits that on the merits of the case, the petitioner was earlier granted regular bail by the coordinate bench of this Court in Crl.P.No.2918/2017 disposed of on 28.06.2017. For the reason that the petitioner had not appeared before the Trial Court on the regular dates of hearing, coercive steps were taken against him and his presence was secured before the Trial Court in the split up case on 10.08.2023 - 3 - HC-KAR NC: 2025:KHC:20652 CRL.P No. 7167 of 2025 and on the said date, he was remanded to judicial custody. Similarly situated accused No.7 has been granted regular bail by this Court in Crl.P.No.3760/2025 disposed of on 02.04.2025. He submits that the petitioner has no other criminal antecedents. 4. Learned HCGP who has opposed the petition, however does not seriously dispute the submission made by learned counsel for the petitioner. 5. Perusal of the material on record would go to show that, on the merits of the case, the petitioner was granted regular bail in the present case in Crl.P.No.2918/2017 disposed of on 28.06.2017. It appears that the petitioner had subsequently absented himself before the Trial Court on the regular dates of hearing. Therefore, a split up case was registered against him in S.C.No.67/2022 and in the said case, the presence of the petitioner was secured by the Trial Court on 10.08.2023 and on the said date, he was remanded to judicial custody. Similarly situated accused No.7 also had failed to - 4 - HC-KAR NC: 2025:KHC:20652 CRL.P No. 7167 of 2025 appear before the Trial Court after he was granted regular bail by the coordinate bench of this Court in Crl.P.No.2918/2017 and thereafter he had approached this Court in Crl.P.No.3760/2025, which was allowed on 02.04.2025. 6. Undisputedly, the petitioner has no other criminal antecedents. For the mistake committed by the petitioner he has been sufficiently punished and he is in custody since 10.08.2023 onwards. Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 7. Accordingly, the following: ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.67/2022 pending on the file of the I Addl. District and Sessions Judge, Ramanagara arising out of Crime - 5 - HC-KAR NC: 2025:KHC:20652 CRL.P No. 7167 of 2025 No.216/2016 registered by Tavarekere Police Station, Ramanagara District, for the offences punishable under Sections 143, 147, 148, 448, 427, 307, 302, 114 R/w 149 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
