BEFORE HONOURABLE MR. JUSTICE N. UNNI KRISHNAN NAIR ORDER Date : 27-10-2025 Heard Mr. B. Baruah, learned counsel for the petitioner. Also heard Ms. A.M. Begum, learned Addl. P.P. Assam appearing for the State/ respondent No. 1 as well as Mr. R. De, learned counsel for the respondent/ Bank. The learned counsel for the parties have submitted that in pursuance to the direction, passed by the learned Sessions Judge, Dibrugarh, in Crl. Revision No. 43(2)/2013, the vehicle in question was handed over to the respondent/ Bank, by the petitioner, herein. It is the submitted by the learned counsel for the respondent/ Bank that the said vehicle was auctioned in the year 2017. After deducting the value received from auction of the vehicle in question, the outstanding due receivable from the petitioner worked out to the tune of Rs. 7,50,000/- Lakh (Rupees Seven Lakhs Fifty Thousand) approximately. Mr. De, on instruction, has submitted that the Bank has written off the said non-
Page No.# 3/3 performing asset and accordingly, as on date, there is no claim against the petitioner, herein. The petitioner also submits that he has also got no claim against the respondent/ Bank. In view of the above position, this Court is of the considered view that the present criminal revision petition is not required to be considered on its merit and is being closed basing on the submissions of the learned counsel for the parties, as noticed hereinabove. Accordingly, criminal revision petition stands closed.
