Mr. Pulak Agarwal, learned counsel for respondent no.5/Insurance Company. 4. The present appeal has been preferred against the judgment and order dated 16.01.2015, passed by the learned M.A.C.T./District Judge, Rudrapur, District Udham Singh Nagar in M.A.C.P. No. 64 of 2013, whereby compensation amounting to ₹4,39,000/- along with simple interest at the rate of 6% per annum has been awarded against the appellant. 5. The matter was taken up today before the National Lok Adalat. 6. Before the Lok Adalat, the parties have amicably agreed to settle the matter. As per the settlement, the Respondent No.5/Insurance Company shall pay a total full and final amount of ₹7,00,000/- to Respondent Nos.1 to 3/claimants, and the appellant, Kumoun Adarsh Motor Yatayat Company shall be exonerated from making any further payments. Respondent Nos.1 to 3/claimants shall not claim any amount apart from the aforesaid compensation, including interest or other claims. The said amount shall be paid by Respondent No.5/Insurance Company within 45 days from today. It is further recorded that Respondent Nos.1 to 3/claimants have not filed any enhancement appeal. The compromise sheet shall form part of the record. 7. Any statutory amount deposited by the appellant, if applicable, shall be refunded to him in accordance with law. 8.
