1. Heard Mr. G Alam, learned counsel for the petitioner/applicant. Also heard Mr. R.J Baruah, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application filed u/s 483 of the BNSS, 2023 praying for grant of bail to the petitioner/applicant namely, Mujammil Hoque in connection
Page No.# 2/3 with Nagaon P.S Case No. 796/2025 u/s 61(2)/316(5) of the BNS, 2023 with corresponding G.R 2265/2025 in connection with which the applicant was arrested on 09.10.2025. 3. The allegation as reflected in the FIR is that on 08.10.2025, the Additional District Commissioner (Education), Nagaon had lodged an FIR before the Senior Superintendent of Police Station, Nagaon making allegations of corruption and malpractice against the main accused one Pallabi Saikia DQM, in the recruitment process of the education volunteers under Laokhowa Education Block. Hence, the case. 4. The Case Diary, which has been called for in connection with another application, is available with learned Addl. Public Prosecutor. 5. Upon perusal of the said Case Diary by learned Addl. Public Prosecutor, it is submitted that there are allegations against the present petitioner upon collecting some money from educational volunteers for the purpose of purchasing educational materials, although the same are supplied by the government. 6. The petitioner has already spent 49 days in custody and the investigation would have progressed by now. 7. Having regard to the above and to the nature of the allegations as well as the fact that main accused has been granted interim pre-arrest bail vide order dated 10.11.2025 in AB No. 2640 of 2025, the above named petitioner shall be released on bail of Rs. 50,000/- with 1(one) surety of the like amount to the satisfaction of the concerned Ld. Trial Court. 8. It is further provided that the petitioner : (i) shall not abscond. (ii) shall be available for trial.
(iii) shall not hamper or tamper the investigation or with the evidence. Page No.# 3/3 (iv) shall not misuse his liberty to commit any illegal acts or offences. 9. Bail application stands disposed of. JUDGE Comparing Assistant
