1. Heard Mr. F. Hoque, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor.

Page No.# 2/3 privilege of pre-arrest bail to the petitioner, namely, Deep Jyoti Saikia , apprehending arrest in connection with Fakirganj P.S. Case No. 53/2025 registered
u/s 191(2)/191(3)/190/329(3)
/ 296/117(2)/118(2)/109/351(2) BNS.
3. The gist of accusation in this case is that on 17.08.2025, one Dildar Hussain had lodged an FIR before the Officer-in-charge of Ahomgaon Outpost under Dhing Police Station, inter alia, alleging that on 15.08.2025, some unknown miscreants have stolen the Bolero Pickup van of the informant bearing Registration No. AS-01-C-9717 from the courtyard of his residence.
4. Scanned TCR was called for in the context of charge-sheet having been filed upon completion of investigation.
5. It is submitted by the learned counsel for the petitioner that the petitioner was earlier granted interim bail on 15.09.2025. It is further submitted that the present petitioner has been sent up for trial and the other charge-sheeted persons are stated to be on bail.
6. Mr. K. Baishya, learned Additional Public Prosecutor submits that there are implicating materials against the present petitioner and he is the main person behind the alleged offence in which other accused are also involved.
7. Considering completion of investigation, rejecting the bail at this stage may not serve much purpose. Therefore, I am of the view that interim should be made absolute subject to suitable conditions.
8. In that circumstances, the interim pre-arrest bail granted vide order, dated 15.09.2025 is hereby made absolute, subject to the following
Page No.# 3/3 conditions- (i) shall be available for the trial; (ii) shall not hamper or tamper with evidence. (iii) shall not indulge in any illegal activity or offence(s). Violation of any of the conditions shall entail cancellation of bail.
9. This disposes off the anticipatory bail application.
