Page No.# 2/3 Sanhita, 2023, the accused petitioner namely, Ashan Ali Sk, has prayed for bail in connection with Bongaigaon P.S. Case No. 203/2025 under Section 305(b)/336(3)/339/340(2)/3(5) and added Section 338 of BNS, 2023. 3. The accused petitioner stated to have been arrested in this case on 04.09.2025 and forwarded on 05.09.2025. 4. The case arose out of an FIR dated 07.08.2025. The gist of the FIR is that the DTO, Bongaigaon had lodged an FIR before the Bongaigaon Police Station with regard to a complaint received from one Apurba Kumar Barman about someone illegally selling his motorcycle bearing registration No. AS-19-G-3149 without his consent as he had not sold the same to anyone. It is further alleged that upon examination of the case, the names of persons - Rafikul Islam, Siddique Ali and Tamizur Rahman emerged and that upon examination of the relevant documents and the vehicle, there was a mismatch of the chassis number of the vehicle and that mentioned in the documents. 5. This is a subsequent bail petition as the earlier bail petition was rejected by this Court on 08.10.2025 in BA No. 3155/2025. 6. The learned counsel for the petitioner submits that the petitioner has been detained in custody since 05.09.2025 and he has spent already 81 days and seeks bail considering length of detention and also perhaps, investigation might be progressed. 7. Case diary, as called for, has been received. 8. The learned Additional Public Prosecutor submits that investigation has revealed sufficient incriminating materials against the petitioner indicating his
Page No.# 3/3 involvement in alleged activity of manipulating documents by selling the vehicle without the actual owner knowing about it.
He has also drawn my attention to para 4 of the bail objection in which narration has been stated about how the vehicle has been sold by fraudulently and manipulating documents. It is also submitted that the investigation has revealed the present accused as the mastermind of such activity and there is a network involved in such offences. 9. In the given facts and circumstances, keeping in mind the seriousness of the allegation, considerable incriminating materials which have revealed by the investigation – this subsequent bail petition of the present accused is also rejected. 10.
