Heard Ms. S. B. Choudhury, learned counsel for the petitioners.
It is submitted by Mr. T. C. Chutia and Ms. M. Bhattacharjee, learned State Counsel, as well as Mr. S. Dutta, learned Standing Counsel, Revenue Department, that the authorities have decided to consider all cases as per the
order of this Court dated 03.04.2025, passed in WP(C) No. 342/2025 (Abdul Kadir Bokshi Vs. State of Assam & Ors.) and batch of writ petitions pertaining to appointment on compassionate ground pending before this Court, which challenges the Office Memorandum dated 18.09.2024, irrespective of whether the persons are the writ petitioners in the case of Abdul Kadir Bokshi (supra) or the connected batch of writ petitions. Accordingly, the applications have been invited wherein the present petitioner has also submitted his application.
Ms. S. B. Choudhury, learned counsel for the petitioners, submits that although she has little reservation that the respondents would consider the case of the petitioner, the petitioner indeed has submitted an application.
Page No.# 5/5 Having considered that the State Authorities have decided to consider all the pending cases irrespective of whether the persons were the petitioners in the above referred case of Abdul Kadir Bokshi (supra) and the batch of writ petitions, and also considering that the petitioner has submitted his application, I am of the considered view that no useful purpose would be served by keeping these writ petitions pending. Accordingly, the writ petitions are closed.
Needless to observe that the respondent authorities shall consider the case of the petitioner on its own merit and in terms of the decision taken by the State for consideration of such cases.
