BEFORE HONOURABLE MR. JUSTICE KALYAN RAI SURANA HONOURABLE MRS. JUSTICE SUSMITA PHUKAN KHAUND ORDER 07.11.2025 (K.R. Surana, J) Heard Mr. A. Ali, learned counsel for the applicant as well as Mr. G. Sarma, learned standing counsel for the Foreigners Tribunal, Ms. S. Katakey, learned standing counsel for the Election Commission of India, Ms. R. Devi, learned CGC and Mr. P. Sarma, learned Addl. Senior Govt. Advocate. 2. By filing this IA, the applicant is seeking extension of time to take bail in terms of order dated 22.01.2025 passed in WP(C) 6848/2024. 3. The applicant projects in this application that after filing of the writ petition he had gone to Karnataka for his livelihood and his learned counsel did not communicate the matter to him as his mobile was out of order. He came home only on 19.10.2025 and the applicant was communicated that the bail was granted but the time of appearance was over. 4. We do not find merit in the submissions because of the fact that as per disclosure made in the affidavit appended to this application, the applicant has stated that the mobile number in which he can be contacted is 7338579002. Page No.# 3/3 The same telephone number is provided in the affidavit appended to the writ petition, being WP(C) 6848/2024. 5. Under such circumstances, the Court is of the considered opinion that the explanation tendered by the applicant for not taking bail within the time allowed cannot be accepted. Accordingly, the prayer made in this application stands rejected. 6.
Be that as it may, it is provided that since the writ petition being WP(C) 6848/2024 is pending for adjudication, in the meantime if the applicant, namely, Md. Amar Ali Alias Aman Ali is apprehended, he shall not be deported out of the Country without order of the Court. 7. The applicant shall cause production of a certified copy of this order before the Superintendent of Police (Border), Darrang to bring it to the notice of the said authority. 8. This application stands dismissed. JUDGE JUDGE Comparing Assistant
