ORAL ORDER
In this petition, petitioner who is accused No.13 seeks quashing of the proceedings registered against him in C.C.No.1539/2017 (Crime No.36/2016 of the respondent – police), pending on the file of Addl.Civil Judge and JMFC, Channapatna, for the offences punishable under Sections 143, 144, 353, 323 and 149 of IPC.
2. Heard learned counsel for the petitioner and learned Addl.SPP for the respondent – police and perused the material on record.
3. Though several contentions have been urged by both sides in support of their respective claims, since the petitioner, who is arraigned as accused No.13, interalia contending that he was not guilty of any of the offences alleged against him, having regard to the fact that the proceedings are pending from 2017 onwards, coupled with the fact that the proceedings in C.C.No.1539/2017 are at the stage of trial, without expressing any opinion on the merits / demerits of the rival contentions, I deem it just and appropriate to dispose of this petition directing the trial court to dispose of the

aforesaid proceedings as expeditiously as possible. However, since the petitioner is said to be residing in UAE from 2012 onwards, petitioner shall be entitled to file an application seeking exemption from personal appearance before the trial court as and when the occasion so arises.
4. Subject to the aforesaid liberty and leaving open all
contentions, petition stands disposed of.
