1. By this application, the applicant seeks to condone the delay of 542 days caused in filing the Appeal.
2. Inspite of service of notice, none appears for respondent nos.3 and 4.
3. The applicant is pursuing litigation to get just compensation towards its acquired land. The applicant states that he was diagnosed with posterior disc bulge, ill defined abnormal marrow signal intensity lesions in dorso lumber spine and pelvic bones and he was under medical supervision. Therefore, he could not have filed Appeal in time.
4. The reasons as stated in the application are not controverted by the respondents.
5. In that view of the matter, case is made out to condone the delay. Hence, following order:
ORDER
(2) 38-ca-11894-2024.odt a. Civil Application is allowed. b. Delay of 542 days caused in filing the present Appeal is hereby condoned. c. Appeal be registered subject to removal of office objections.
