order dated 15.05.2025 directing the respondents to admit the non-applicant/petitioner in B.Sc. (Nursing) Course in any Nursing College under the Armed Forces Medical Services, as one seat is lying vacant for her by the order of this Court dated
15.10.2024. Counsel submits that two semesters of the B.Sc. (Nursing) Course of the relevant session have already been completed, so under these circumstances, the petitioner cannot be granted admission for the relevant year, as the petitioner would not be in a position to pursue her studies. Hence, the applicants-respondents are ready and willing to comply with the orders passed by this Court by granting admission to the petitioner in the subsequent session, which is going to commence from the month of August, 2025. Counsel further submits that the validity period of medical examination of the petitioner has already over, hence, she is supposed to undergo the said process again. Counsel submits that the aforesaid modification is required under the prevailing facts and circumstances of the case.
3. Counsel for the non-applicant/petitioner - Sakshi Choudhary has no objection, in case order dated 15.05.2025 passed by this Court is modified to the above extent.
4. Heard the submissions made by respective counsels.
5. So far as the validity period of medical examination of the petitioner is concerned, no such prayer has been made in the instant application directing the petitioner to undergo fresh medical examination. Conducting a fresh medical examination
(3 of 3) [WMAP-339/2025] would further create more complications. This Court has already dealt with the issue of medical examination of the petitioner, that is why the order dated 15.05.2025 was passed directing the applicants-respondents to grant admission to the non-application/petitioner.
6. Considering the arguments put forward by learned counsel for the applicants-respondents, the instant misc application stands allowed. The order dated 15.05.2025 stands modified.
7. The applicants-respondents would be at liberty to grant admission to the petitioner in B.Sc. (Nursing) Course in any Nursing College under the Armed Forces Medical Services in next academic session, which is going to commence from August, 2025. Rest of the order would remain as it is.
