Heard the parties.
2. Both these bail applications arise out of the same police case. Accordingly, both these bail applications are being disposed of by a common order.
3. The petitioners have been made accused in connection with Mandu (Kujju) P.S. Case No. 125/2024, for the offences registered under Sections 15(c), 22(c) 25, 27(a) & 29 of the N.D.P.S. Act, pending in the Court of learned Principal District and Sessions Judge, Ramgarh- cum-Special Judge, N.D.P.S., Ramgarh.
4. On 04.06.2024 at about 11:45 P.M., Mandu (Kujju) police intercepted a truck being registration no. JH02BA-1998 and XUV Vehicle bearing registration no. JH01DH-9760 from the service lane Murpa, Kujju. On search, 2405.3 Kgs. of Doda was recovered from the seized truck while 1 Kg of Doda was recovered from the seized XUV
vehicle. The petitioners are alleged to be travelling in the seized XUV Vehicle.
5. Mr. B.M. Tripathi, learned senior counsel appearing on behalf of the petitioners has drawn attention towards the information obtained by him through R.T.I. Act from the Project Director, PIU/ Ranchi, N.H.A.I., as to when these two vehicles had crossed the Toll Gate at Hazaribagh-Ramgarh. From perusal of which, it appears that the seized truck had crossed the Toll Gate at 8:50 P.M., while the seized XUV vehicle has crossed the Toll Gate at 11:27 P.M.
6. It was submitted that the seized XUV vehicle was not intercepted alongwith seized truck rather the police had instituted a false case that both the vehicles were intercepted together and the police implicated these petitioners showing that 1 Kg. of Doda was recovered from the said XUV vehicle.
7. Learned A.P.P. after going through the information obtained from the R.T.I., does not raise any doubt towards the authenticity of this information. However, it was submitted that the petitioners have confessed their guilt.
8. In view of the aforesaid facts, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are
directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Principal District and Sessions Judge, Ramgarh-cum-Special Judge, N.D.P.S., Ramgarh.in connection with Mandu (Kujju) P.S. Case No. 125/2024.
