HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 314/2025 Narayan S/o Omprakash, Aged About 33 Years, R/o Near Maharaja School, Civil Line, Police Station, civil Lines, District Ajmer.(At Present Confined In Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through P.p. ----Respondent Connected With S.B. Criminal Miscellaneous Bail Application No. 315/2025 Ranglal S/o Jagannath, Aged About 45 Years, R/o House No. 56, Shreeji Vihar, Faisagar Road, Police Station Ganj, District Ajmer, Rajasthan.(At Present Confined In Central Jail Jaipur.) ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Mahendra Kumar For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 30/01/2025 1. These instant bail applications have been filed under Section 483 B.N.S.S. on behalf of the accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.40/2024 registered at Special Police Station (SOG), District ATS and SOG for the offence(s) under Sections 420, 467, 468, 471 and 120B of IPC and Section 66D of IT Act. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in these cases. It is contended that similarly placed co-accused Dinesh Jagarwal and Manoj Kumar have already been enlarged on bail by this Court vide orders dated 23.01.2025 and 20.01.2025. It is also contended that the charge-sheet has already been submitted and the matters are exclusively triable by Magistrate. The accused- petitioners are in custody since long and trial/investigation of the (2 of 2) [CRLMB-314/2025] case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposed the bail applications and contended that the accused-petitioners have issued forged tie-sheets and on the basis of that forged certificates were issued to the other co-accused who appeared in the examination conducted by Rajasthan Directorate of Education, therefore, the bail applications of the accused-petitioners deserves to be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by counsel for the parties and looking to the fact that the accused-petitioners are in custody since long and the charge-sheet has already been filed, the matters are exclusively triable by Magistrate and the other co- accused have already been enlarged on bail, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners- (1) Narayan S/o Omprakash (2) Ranglal S/o Jagannath, in connection FIR No.40/2024 registered at Special Police Station (SOG), District ATS and SOG, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
