Cr.MP(M) No. 2913 of 2025 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant for condonation of delay in maintaining the accompanying Criminal Appeal, which is barred by limitation. Despite opportunity, no reply has been filed to the application, however this Court is convinced and satisfied that delay in maintaining the accompanying appeal is neither intentional nor willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant and as such, delay, which has been sufficiently explained, is condoned. The application is disposed of. Cr.MP(M) No. of 2026 (CRMPST/10661/25) Heard. Leave to appeal granted. Application stands disposed of. Criminal Appeal No. of 2026 Be registered Admit. Bailable warrants in the sum of Rs. 25,000/- with one surety in the like amount to the satisfaction of the Arresting Police Officer be issued against the respondent, undertaking to appear in this Court as and when directed and to receive any sentence, which may be imposed on the conclusion of the appeal.
