The appellant, ICICI Lombard General Insurance Company Limited, is represented by its duly authorized official, namely, Mr. Bitopan Gogoi, Legal Manager. The claimant, namely, Jagadish Thakuria, is present in person along with his engaged counsel, Ms. P. Pegu. Page No.# 3/3 It is submitted that the total awarded amount is Rs. 17,67,045/- (Rupees seventeen lakhs sixty seven thousand forty five) only. After negotiation, both the parties have mutually agreed to settle the matter for an amount of Rs. 23,33,522/- (Rupees twenty three lakhs thirty three thousand five hundred twenty-two) only, out of which Rs. 8,83,522/- (Rupees eight lakhs eighty three thousand five hundred twenty two) only has already been paid, and the balance amount Rs. 14,50,000/- (Rupees fourteen lakhs fifty thousand) only is agreed upon as a full and final settlement of the claim. Accordingly, the appellant/ICICI Lombard General Insurance Company Limited is hereby directed to deposit the balance amount of Rs. 14,50,000/- (Rupees fourteen lakhs fifty thousand) only before the Registry of this Court within 1 (one) month from the date of the order and the claimant, Jagadish Thakuria, is permitted to withdraw the amount on being proper verification and identification. Statutory deposit, if any, shall be returned to the Insurance Company. The appeal stands disposed of in terms above. JUDGE Comparing Assistant
