------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Mahavir Pd. Sinha, Advocate. Mr. Santosh Kr. Jha, Advocate For the State : Mr. Fahad Allam, A.P.P.
Mr. Gautam Rakesh, APP ----- 06/ 25.06.2025 Heard the parties. 2. These anticipatory bail applications under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, have been preferred by the petitioners apprehending their arrest for offences registered under Sections 302/34 of the Indian Penal Code. 3. The wife of the deceased in this case died an unnatural death for which Harla PS Case No. 70 of 2024 was instituted against the deceased of this case and other family members under section 302 of the Indian Penal Code. Immediately on the next day the deceased of this case was found hanging near the CISF Camp from a tree. This FIR was lodged by the father of the deceased alleging that the petitioners who are the in- laws have committed the murder. 2025:JHHC:17029 2
4. Learned A.P.P. after going through the inquest report and postmortem report suggests that except the ligature mark on the neck there is no other injury on the person of the deceased. 5. It is stated that the deceased might have committed suicide. 6. After hearing the parties, I find that cause of death is cardiorespiratory failure as a result of asphyxia due to antemortem hanging. These petitioners are the in-laws of the deceased. Admittedly earlier there was a criminal case against the deceased for committing murder of his wife. 7. On the aforesaid background and considering the fact that primafacie this is a case of suicide, this Court finds it a fit case for grant of anticipatory bail to the petitioners. 8.
Accordingly, these Anticipatory Bail Applications stand allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M.F.C., Bokaro, in connection with Harla P.S. Case No.71 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
