Aftab, son of late Nur Mohammad 4.Khurshid Anwar @ Mohammad Khurshid Anwar, son of late Nur Ahmad 5.Fujail Ahmad @ Mohammad Fujail, son of late Nur Mohammad 6.Shakil Ahmad @ Mohammad Shakil Ahmad, son of late Nur Mohammad All residents of village Sisai Road Ghato Bagicha Gupta, PO and PS Gumla, District Gumla, Jharkhand … … Petitioner(s) Versus 1.The State of Jharkhand. 2.Ashish Kumar Chaurasia, son of late Bahadur Prasad, resident of village Majhi Ganwa, PO and PS Chainpur, District Palamu, Jharkhand
… … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Indrajit Sinha, Advocate. For the State : Mr. Nehala Sharmin, Spl.P.P. ----- 04/ 19.06.2025 Heard the parties.
2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Sections 406 and 420 of Indian Penal Code pending in the Court of learned SDJM, Palamu in connection with Chainpur PS Case 20 of 2024.
3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
4. Admittedly the maximum punishment for the offence is seven years or less. It is the case of the petitioners that notice under section 41A of Cr.PC has been issued to the petitioners.
5. Since notice under section 41A of Cr.PC has been issued it is clear that the police does not have any intention to arrest these petitioners. Thus, anticipatory bail application at this stage where there is no apprehension of arrest of the

petitioners, is misconceived.
6. Thus, I am not inclined to entertain this anticipatory bail application and, is accordingly, disposed of.
7. The petitioners should appear before the investigating officer for compliance of notice under section 41A and take appropriate steps as per law.
