... Applicant versus The State Of Chhattisgarh Through S.H.O., Police Station - Kotwali, Ambikapur, Dist. Surguja (C.G.)
... Non-applicant For Applicant : Mr. Rishikant Mahobia, Advocate. For Non-applicants : Mr. Jitendra Shrivastava, Advocate.
Hon'ble Mr. Ramesh Sinha, Chief Justice
Order on Board 26.06.2025
1. This first bail application has been filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 555 /24 registered at Police Station Kotwali, Ambikapur, District Surguja (C.G.), for the offences punishable under Section 420, 467, 468, 471, 120-B read with Section 34 of the IPC.
2. It is alleged by complainant namely Nazil that on 16.08.2024, employee of Hinduja Leyland Finance, Ambikpuar has informed him that a vehicle
2 i.e. Bullet has been financed by complainant from Hinduja Leyland Finance, Ambikapur and he is not paying installment. When the complainant inquired the matter then it was found that on 23.11.2023, the applicant has misused his document and purchased vehicle from Victoria Automobile, Manendragarh, District – Koria (C.g.) in the name of complainant through finance. Based on aforesaid facts, present crime has been registered against the applicant and he has been arrested on 23.12.2024.
3.
Learned counsel for the applicant would submit that the applicant has been falsely implicated in the crime in question. He submits that the applicant has neither purchased the vehicle nor has any participation in financing of the vehicle registered in the name of complainant, he has also not gained any benefit from the said transaction. He submits that similarly situated co-accused person namely Manish Davi has already been released on bail by trial Court vide order dated 09.04.2025, hence, the applicant is also entitled for bail on the ground of parity. He further submits that the applicant is languishing in jail since 23.12.2024; charge-sheet has already been filed and conclusion of the trial is likely to take considerable time, hence, the applicant may be enlarged on bail. 4. Per contra, learned counsel for the State while opposing the bail application would submit that looking to the gravity and seriousness of the crime and the manner in which, alleged offence of cheating is said to have been committed by the applicant, he is not entitled for grant of bail. He submits that case of Manish David, who is said to be co- accused of the case, is distinguishable to the case of the present applicant, as he is only Manager of Showroom, from where, the alleged
3 vehicle has been purchased, and online transactions were made to the Showroom through him. 5. I have heard learned counsel for the parties and perused the material placed on record. 6. Having heard learned counsel for the parties, having regard to the facts of the case, particularly, considering the nature & gravity of the offence, looking to the seriousness of the crime and the fact that case of co- accused namely Manish David is distinct from the present applicant because he (Manish David) is manager of the Showroom, from which the alleged vehicles were purchased, and the online transactions were done in the showroom through him, thus, without commenting on merits of the case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant namely Shahrukh Khan, involved in Crime No. 555/2024 registered at Police Station Kotwali, Ambikapur, District Surguja (C.G.), for the offences punishable under Section 420, 467, 468, 471, 120-B read with Section 34 of the IPC. is rejected. 8.
Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. -
