Heard Mr. U. S. Bora, learned counsel for the petitioner as well as Mr. B. Kaushik, learned Standing Counsel, Secondary Education Department for all the

[2.] The learned counsel for the petitioner submits that the petitioner is aggrieved with the conclusion drawn by the departmental proceeding through the Inquiry Report submitted on 23.07.2025 by the Inquiry Officer while the criminal investigation against the petitioner on the same set of facts is pending. [3.] The learned counsel submits that although the petitioner has participated in the inquiry proceeding but since the criminal proceeding is yet to proceed and conclude, the respondent authorities at the same time having overlooked the vital evidence while relying upon inadmissible materials and not considering the defence of the petitioner, the petitioner has been caused grave prejudice. Accordingly, the petitioner had filed this representation against the Inquiry Report on 01.09.2025 which has not been considered by the respondents till date. [4.] Considering the above projection, instead of keeping the writ petition pending, the writ petition is disposed of by directing the respondent authorities concerned to consider and dispose of the representation submitted by the petitioner within a period of one month from the date of receipt of a certified copy of the order. [5.] The writ petition is accordingly stands disposed of.
