The Court made the following Judgment: The Second Appeal is preferred by the appellants/defendants against the Judgment and Decree dated 09.04.2003, passed in A.S.No.38 of 1998, on the file of the learned Senior Civil Judge, Chodavaram, confirming the Judgment and Decree dated 09.09.1998 in O.S.No.10 of 1995, on the file of learned Principal Junior Civil Judge, Chodavaram. 2. Today, when the matter is taken up for hearing, learned counsel for the Appellants submits that, as per his instructions, Appellant Nos.1 and 2 have passed away. Despite having addressed a letter regarding this matter, no response has been received, nor have any instructions been provided to implead the legal representatives of the Appellant Nos.1 and 2. It appears that the legal representatives of the Appellants are also not showing any interest to proceed with the case. 3. In view of the above, the Second Appeal is dismissed as abated. There shall be no order as to costs. Interim orders granted earlier, if any, shall stand vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ T.
