The present petition has been filed seeking a direction to respondent No. 2, the Tehsildar (Tamkuhiraj), District Kushinagar, to decide Suit No. 7305 of 2023 [Vina Kumar Vs. Trilok @ Trilok Chandr Gupta], under Section 35 of the U.P. Revenue Code, 2006, within a stipulated time period. The order sheet of the case, a copy whereof has also been appended to the writ petition indicates that although several dates have been fixed, but the matter is being adjourned for some reason or the other. Accordingly, the petitioner, by way of the present petition, has sought the proceedings to be concluded expeditiously. Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondent(s) and Sri Brij Kumar Saroj, learned Advocate holding brief of Sri Sudhir Bharti, learned counsel who represents the respondent-Gram Sabha, have no objection if the proceedings are expedited. Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court concerned would make an endeavor to decide the aforesaid case, in accordance with law, expeditiously preferably within a period of three months from the date of production of certified copy of the instant order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
