Barbhuiya, learned counsel for the petitioner, who, after realizing that the present writ petition would not be maintainable as the maintenance allowance award is in accordance with Section 31 of the Navy Act, 1957, against which a petition lies under the Armed Forces Tribunal Act, 2007, fairly submits that he may be allowed to withdraw this writ petition with liberty to avail the remedy under the law. Ms. A. Phukan, learned CGC for the respondents is present. Considering above, the prayer for withdrawal is allowed. Accordingly, the writ petition stands closed on withdrawal, with liberty as prayed for.
