[2025:RJ-JP:34571] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Commandant, Army Centre, Nasik Road Camp 908802 C/o 56 APO 2. Director General Of Artillery, (Arty-10) 3. Integrated HQ Of MOD (Army), C-Wing, Sena Bhawan, New Delhi-110011. 4. Rahul Yadav Employee No. 15230861F Nayak (OPR), 147/81 Field Regiment C/o 56 APO ----Respondents For Petitioner(s) : Mr. Anil Kumar Sharma For Respondent(s) : HON'BLE MR. JUSTICE ANAND SHARMA Order 29/08/2025 1. This writ petition has been filed by the petitioner with a prayer to issue direction to the respondents to take action against one Shri Rahul Yadav, who is holding the post of Nayak pointing out irregularity in his appointment which took place in the year 2011 on account of not securing 45% marks in Class-X. 2. Admittedly, the petitioner is a private person and learned counsel for the petitioner has utterly failed to disclose any locus of the petitioner to file writ petition under Article 226 of the Constitution of India to seek direction as sought in the instant writ petition. [2025:RJ-JP:34571] (2 of 2) [CW-12059/2025] 3. In addition to above, no explanation has been given for filing the writ petition with delay of 14 years. 4. Even otherwise, Article 300 of the Constitution of India makes it obligatory to implead Central Government through Union of India. In the instant case, even the petitioner has not impleaded Union of India as party to the writ petition. 5. For the reasons mentioned hereinabove, there is no scope for interference under Article 226 of the Constitution of India. Hence, the writ petition filed by the petitioner is hereby dismissed.
