1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.182/2025, registered at Police Station Amer, District Jaipur (North), for the offence(s) under Section 316(5) of BNS. 2. It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated under Section 316(5) of the BNS. It is further submitted that the charge-sheet has already been filed and the alleged offence is exclusively triable by the Magistrate. It is also contended that the petitioner has already deposited the alleged amount of ₹8,66,810/- before lodging of the FIR. It is argued that there are no criminal antecedents against the petitioner and the trial of the case may take considerable time,
[2025:RJ-JP:35941] (2 of 2) [CRLMB-9874/2025] therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on record. 5. The charge-sheet against the petitioner under Section 316(5) of BNS has already been filed and the accused-petitioner is in custody since 24.07.2025. The alleged offences are exclusively triable by Magistrate and the trial of the case may take considerable time, therefore, without expressing anything on the merits of the case, this Court deems it proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Rakesh Kumar Meena S/o Shri Kedar Meena, in connection with FIR No.182/2025, registered at Police Station Amer, District Jaipur (North), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
