Bora, learned counsel for the petitioner submits that as per his instructions, the petitioner appeared before the IO as per the terms granted in

The gist of the allegations in the FIR is about one person named Sanjib Athaparia taking loan from Mahindra Finance and the allegation of fraudulent activities with regard to the same including defaulting in paying payment of the loan. The present petitioner is stated to be guarantor of the said loan which is also mentioned in the order dated 20.02.2025. Heard Shri D. Bora, learned counsel for the petitioner. Also heard Shri P. Borthakur, learned Addl. PP, Assam. This application under Section 482 of BNSS, 2023 (under old act Section 438 of the Cr.PC) for granting of Anticipatory Bail to the petitioner, namely, Dwipen Athparia, who is apprehending his arrest in connection with Jalukbari PS Case No. 74/2025 under Sections 61/315/316(2)/318(2)/321/336(2) of BNS, 2023. Considering the long pendency of the petition, the interim bail granted on 20.02.2025 is hereby made absolute with the following conditions: (i) That the accused person shall appear before the I/O within a period of 10 (ten) days and make himself available for examination. (ii) That the accused person shall not hamper or tamper with evidence. (iii) He shall cooperate with the remaining investigation as and when required. In case of violation of any bail conditions, bail will be liable to be cancelled. Accordingly, the anticipatory bail application stands disposed of.
