Islam, learned counsel for the petitioner and Mr. R.J. Baruah, learned Addl. Public Prosecutor, Assam for the State respondent. This application has been preferred by the petitioner namely, Amina Ahmed under Section 482 (1) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for pre-arrest bail, apprehending arrest in connection with Fakirganj P.S. Case No. 38/2025 (Corresponding to G.R. Case No. Page No.# 2/2 617/2025) under Sections 96/ 127(3) of the BNS, 2023. The allegation as contained in the FIR is that the daughter of the informant aged about 17 years 4 months was found missing on 10.04.2025 and the informant came to know from a reliable source that the accused/ petitioner kidnapped his daughter from the vicinity of their house and confined her in an unknown place. The case diary has been received and perused. It is submitted by the learned Additional Public Prosecutor that the role of the present petitioner is confined to informing the victim girl and the accused that the police has gone to look for them in Bengalore where the couple was staying and thereafter the couple fled. Pursuant to the interim protection, the petitioner appeared before the I.O. and her statement has been recorded. Having regard to the above, the prayer for pre-arrest bail is allowed. Accordingly, the interim order dated 21.08.2025 is made absolute subject to the conditions contained in the interim order itself. The petition stands allowed and disposed of.
