THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE PRADEEP SINGH YERUR ORAL ORDER This petition is filed by the petitioner-wife seeking transfer of the petition preferred by the respondent- husband in M.C. No.71/2024 pending on the file of Prl. Senior Civil Judge, Chitradurga to the Family Court at Bengaluru. 2. It is the contention of learned counsel for petitioner that petitioner received summons from the Court of Senior Civil Judge & CJM, Chitradurga at the - 3 - NC: 2025:KHC:4827 CP No. 207 of 2024 instance of the petition initiated by the respondent/husband for divorce. It is contended that petitioner is residing with the minor child - Harsha, aged about 3 years at Bengaluru and respondent is also residing at Bengaluru. Under the circumstances, it would be difficult for the petitioner-wife to travel to Chitradurga alongwith the child to attend the case of divorce initiated by the husband. Therefore, petitioner seeks for transfer of the divorce petiton filed by the respondent-husband to the Family Court at Bengaluru. 3. Learned counsel for respondent does not have any serious objection for transferring the divorce petition pending before the Chitradurga Court to the Family Court at Bengaluru. 4. Having heard learned counsels for the parties, it is seen that petitioner is residing with the minor child at Bengaluru and the respondent is also residing at Bengaluru. Therefore, it is apparently seen that less amount of hardship would be caused to both the parties if - 4 - NC: 2025:KHC:4827 CP No. 207 of 2024 the divorce petition is transferred to Bengaluru. The respondent also does not have any serious objection in transferring the divorce petition pending before the Chitradurga Court to the Family Court at Bengaluru. Therefore, in the interest of both the parties, this Court deems it appropriate to transfer the divorce petition pending before the Chitradurga Court to the Family Court at Bengaluru. 5. Accordingly, I pass the following: O R D E R i) Petition is allowed ii) The matrimonial proceedings in M.C. No.71/2024 pending on the file of the Prl Senior Civil Judge & CJM, Chitradurga is ordered to be transferred to the Family Court at Bengaluru. Ordered accordingly.
