Heard Mr. Y.S Mannan, learned counsel for the accused/petitioner. Also heard Mr. R.J Baruah, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application u/s 482 of the BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioner namely, Muhammed Afil Uddin in connection with Patacharkuchi P.S Case No. 210/2025 u/s 113(3)/152/352/353(2)/196 of BNS, 2023. Page No.# 2/2 3. As per the allegations contained in the FIR is that the petitioner had made a comment, in respect of a news item which appeared in Axom Live 24 news channel and the said comment is as follows “In spite of the fact that the BJP Govt. is ruling in Delhi how such an incident occurred? Why do such incidents happened in the country whenever there is an election?” It is submitted on behalf of the petitioner has been issued a notice u/s 35(3) BNS, 2023 by the I/O for appearance on the 10th of December, 2025. 4. Mr. R.J Baruah, learned Addl. Public Prosecutor for the State of Assam has strongly opposed the prayer for pre-arrest bail. 5. Having regard to the above and the nature of the allegations, it is provided that in the event of his arrest, the above named petitioner shall be released on pre-arrest bail of Rs. 50,000/- with 1(one) surety of like amount to the satisfaction of the arresting authority in connection with the aforesaid case. 6. It is further provided that the petitioner shall cooperate with the investigation and shall not try to influence the witnesses or hamper the investigation in any manner. 7.
