Neutral Citation No. - 2025:AHC:35375 Court No. - 10 Case :- WRIT - A No. - 3082 of 2025 Petitioner :- Ajay Kumar Rai And 8 Others Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Gyanendra Bahadur Rai,Jitendra Kumar Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Jitendra Kumar, learned counsel for petitioners and Sri Dhirendra Pratap Singh, learned Standing Counsel for State- Respondents. 2. Petitioners-2 to 9 are fence seater since they have retired way back in the years 2009 to 2019 and now they have approached this Court to claim gratuity in the light of judgments passed by this Court. So far as Petitioner-1 is concerned, he has retired recently on 20.06.2024. 3. Learned Standing Counsel appearing for State-Respondents submits that to claim gratuity and approach this Court at belated stage would be an adverse factor to consider the claim of petitioners. 4. I have considered the above submissions and taken note of above referred delay. Still considering that now petitioners are before this Court, therefore, this writ petition is disposed of with observation that their claim for gratuity be considered in the light of various judgments passed by this Court. However, while deciding their claim factor of delay may also be taken note of. Order Date :- 11.3.2025 AK Digitally signed by :- AWADESH KUMAR High Court of Judicature at Allahabad
