The case of the prosecution is that on 06.06.2025 at about 6.00 P.M., opposite to Muthugudem Police Station, the Sub Inspector of Police, Mothugudem Police Station along with his staff and mediators apprehended the petitioner herein and other accused while he was in possession of 100 Kgs of ganja. The police seized the ganja under the cover of a mediatornama and registered an FIR. During the investigation, the accused were apprehended and remanded to judicial custody on 06.06.2025. Mr.T.D.Phani Kumar, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is permanent 3. 3 resident of Guduru Panchayat, Chintur Mandal and undertake to strictly adhere to any conditions that may be imposed by this Court. Learned counsel further submits that the petitioner was arrested on 06.06.2025 and since then he has been in the judicial custody for allegedly indulged in 100 Kgs of ganja transportation and possession. Learned counsel further submits that the petitioner, is undergoing dialysis process and it is urged to enlarge the petitioner/Accused No.2 on bail. 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor submits that the contraband involved in this case is commercial quantity. Some more material witnesses have to be examined and investigation is still pending, and it is urged to dismiss the bail application. Heard the learned counsel for the petitioner and the learned Assistant 5. Public Prosecutor. Perused the record. As seen from the record, the petitioner was allegedly indulged in 6. possession and transportation of 100 Kgs of ganja which is commercial quantity. This Court on 11.08.2025, passed an order directing the Superintendent, Central Prison, Rajamahendravaram to submit the medical report of the petitioner/Accused No.2 in this case. The Superintendent of Jails, Central Prison, Rajamahendravaram, East Godavari District has submitted a report vide Lr.No.CPR/CRC/7859/2025, dated 12.08.2025 about medical condition of the petitioner. It is submitted that the petitioner has Serum Creatinine levels of 10.4 on 09.08.2025. There are no Nephrologist services 4 available in the Government Hospitals at Rajamahendravaram or Kakinada. The Superintendent of Jails, Rajamahendravaram submits that the petitioner needs minimum admission for atleast 15 days to two (2) months, but due to escort constraints possibilities of admission are slim. \ 7. Considering the health condition of the petitioner, this Court is inclined to enlarge the petitioner on bail with the following conditions: i. The petitioner/Accused No.2shall be enlarged on bail subject to he executing a personal bond for a sum of Rs. 10,000/- (Rupees Ten thousand only), with two sureties for the like sum each to the satisfaction of the learned Judicial First Class Magistrate Rampachodavaram. The petitioner/AccusedNo.2shallnot leave the limits of the State of Andhra Pradesh, without prior permission from the Station House Officer concerned. iiii. The petitioner/Accused N 3.2shall not commit or indulge in commission of any offence in future. The petitioner/Accused No.2shall cooperate with the IV. investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. The petitioner/Accused No.2shall not, directly or indirectly. V. make any inducement, threat or promise to any person f 5 acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. Accordingly, the Criminal Petition is allowed. 8.
