THE COURT MADE THE FOLLOWING JUDGMENT:
The Second Appeal is preferred by the appellant against the Judgment and Decree dated 20.11.1999, passed in A.S.No.82 of 1993, on the file of the learned IV Additional District Judges Court, Tirupati, Chittoor District.
2. On 16.12.2024, learned counsel for the appellant submitted that despite their best efforts, they could not contact the appellant and hence, this Court ordered the Registry to issue notice to the appellant.
3. Today, when the matter is taken up, it is brought to the notice of this Court that notice sent to sole appellant was served. Though notice served on appellant, he did not choose either to give instructions to the present learned counsel on record or engaged another counsel, to represent the matter.
4. It seems that the appellant is not interested to prosecute the matter. Hence, this Court has no other alternative except to dismiss the appeal.
5. In the result, the Second Appeal is dismissed for default. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
Miscellaneous petitions pending, if any, in this appeal shall stand closed.
