DATE PC : The petitioner claims that proceedings initiated under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, “SARFAESI Act”) have since been challenged by the petitioner in S.A.No.685 of 2024, before the D.R.T., Visakhapatnam, which was filed on 30.12.2024. 2. It is stated that on 31.12.2024, counsel for respondent No.1 - South Indian Bank Limited, sought for time to file the response and the matter has now been adjourned to 09.01.2025. 3. In the meantime, it is stated that an Advocate Commissioner, has been appointed by the Chief Judicial Magistrate of Rajamahendravaram, East \ 2 HCJ & RCJ ' WP_362_2025 Godavari District and the possession was to be taken over by the said Advocate Commissioner on or before 09.01.2025. It is stated that in case the premises of the petitioner is not protected, S.A. filed before the D.R.T. would become academic. Considering the peculiar facts and circumstances of the case, with a to prevent the proceedings before the D.R.T. from becoming infructuous or rendering academic, we order that stdtus quo be maintained with regard to the possession of the petitioner as it exists today, till such time as appropriate orders are passed by the D.R.T. Visakhapatnam, in the Interim Application No.4129 of 2024, accompanying the S.A. No.685 of 2024. 4. view We make it clear that in case, the D.R.T. finds that the proceedings are delayed by the petitioner, it shall be open to the said Tribunal to pass appropriate orders. 5.
