Accused in Crime No.60/2025 registered by Kothanur Police Station, Bangalore, for offences punishable under Sections 64(2)(m), 79, 352, 318(2) of BNS 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. First Information Report in Crime No.60/2025 was registered by Kothanur Police Station, Bangalore, for the aforesaid offences against the petitioner herein, based on the first information dated 18.03.2025 received from the victim lady aged about 36 years. During the course of investigation of the case petitioner herein was arrested on 21.03.2025 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional - 3 - HC-KAR NC: 2025:KHC:18650 CRL.P No. 6987 of 2025 Sessions Court in Crl.Misc.No.2808/2025 was rejected on 15.04.2025, therefore, he is before this Court. 4. A perusal of the material on record would go to show that petitioner and the victim lady are acquainted with each other for the last about three years. In the first information, which is submitted by the victim lady she has stated that she is married and has got two children and she got acquainted to the petitioner about three years earlier in face book and thereafter, they are in constant touch with each other. She has also stated that she is working as a Tailor and she had given money to the petitioner on his request and when the petitioner came to her house to receive the money, he had sexual intercourse with her, against her wishes and thereafter, he was threatening her stating that he had her personal photographs, which he would be circulating in the social media. She has further alleged that thereafter, she has paid to the petitioner a total sum of Rs.12,40,000/- and she also had pledged her gold for paying him money. She - 4 - HC-KAR NC: 2025:KHC:18650 CRL.P No. 6987 of 2025 has further stated that when she had asked him to return the money, he had refused to return the money and on the other hand, he had threatened to circulate her private photos and videos and also send the same to her husband. From the aforesaid allegation it appears that petitioner and the victim lady were in relationship for the past about three years and dispute has now arisen between them with regard to payment of money, which allegedly the petitioner has borrowed from the victim lady. Investigation of the case is completed and charge sheet has already been filed. Petitioner, who has no other criminal antecedents, is in custody from 21.03.2025. 5. Considering the aforesaid aspects of the matter, more so, the nature of allegations found in the FIR and the charge sheet, which is filed against the petitioner, I am of the opinion, his prayer for grant of regular bail is to be answered in the affirmative. The petitioner is directed to be enlarged on bail in Crime No.60/2025 of Kothanur Police Station registered for the offences punishable under Sections 318(2), 352, 79, 64(2)(m) of BNS 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (one lakh) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 6 - HC-KAR NC: 2025:KHC:18650 CRL.P No. 6987 of 2025 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
