M/s Goldy Footwears Vs. H.P. Gramin Bank Cr. Revision No.483 of 2025 17.03.2026 Present: Mr. Amar Deep Singh, Advocate, for the applicant/petitioner. Cr.MP No.925 of 2026 By way of instant application filed under Section 72(2) of the BNSS, prayer has been made on behalf of the applicant/petitioner for cancellation of non-bailable warrants issued against him vide order dated 08.01.2026. 2. It is averred in the application, which is duly supported by affidavit, that bailable warrants issued in terms of order dated 11.12.2025 for securing the presence of the applicant/petitioner on 08.01.2026 were never served upon him, rather factum with regard to issuance of non-bailable warrants vide order dated 08.01.2026 came to his knowledge on 16.03.2026, while he had come to the office of his counsel at Shimla. 3. Since applicant/petitioner is ready and willing to put in appearance on 19.03.2026, for which date, non-bailable warrants have been issued, prayer has been made to cancel the non-bailable warrants. 4. Having taken note of presence of applicant/petitioner, present in Court, this Court is persuaded to accept the prayer made on behalf of the applicant/petitioner and accordingly, non-bailable warrants issued in terms of order dated 08.01.2026 for securing the presence of applicant/petitioner on 19.03.2026 is cancelled, but he is directed to remain present in Court on the said date. It is made clear that in case he fails to come present on 19.03.2026, on his own, this Court would be compelled to cause presence of applicant/petitioner with the help and aid of Police.
