Heard Mr. M.K Sharma, learned counsel for the petitioners. Also heard Mr. B Sarma, learned Additional Public Prosecutor for the State of Assam. 2. By this application filed under Section 482 of the BNSS, 2023 the petitioners haveprayed for pre-arrest bail in connection with Paltan Bazar P.S Case No. 278/2025 (corresponding to G.R Case No. 4544/2025) under Section 69/318(2)/336(2)/337/351(3)/61(2) (b)/85 of the BNS, 2023. 3. The FIR reveals that the informant’s husband had induced the informant to go to a hotel and have sexual intercourse with her. It was further alleged that the incident occurred when their divorce proceeding was pending before the Ld. Principal Judge, Family Court Page No.# 3/3 No. 2, Guwahati. It was also alleged that the informant got pregnant and she had a miscarriage. 4. Mr. M.K Sharma, learned counsel for the petitioners submits that the petitioners are no way involved in the instant case and that the entire story, projected in the FIR, was a concocted. 5. Be that as it may, the petitionerswere enlarged on interim pre- arrest bail vide order dated 09.10.2025 with the condition that the petitioners may appear before the I/O and within a period of 7(seven) days from the date of the order and in compliance of the said direction, the petitioners appeared before the I/O and got their statement recorded. 6. In view of the same, it seems that the petitioner’s cooperated with the investigation of the case and as such, this Court deems it fit that order dated 09.10.2025, by which the petitioners were enlarged on interim pre-arrest bail be made absolute with the further conditions that the petitioners may comply with the already mentioned directions in the said order without fail. 7.
