Neutral Citation No. - 2025:AHC:35412 Court No. - 79 Case :- MATTERS UNDER ARTICLE 227 No. - 2391 of 2025 Petitioner :- Saeed Ahmad Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Manish Kumar Kesarwani,Mohd. Kalim Counsel for Respondent :- G.A. Hon'ble Saurabh Srivastava,J. 1. Heard Mr. Mohd. Kalim, learned counsel for the petitioner and learned A.G.A. for the State. 2. Through the instant petition, specific prayer has been made to conclude the trial of Case No.1846 of 2024 (State vs. Javed and Others) arising out of Case Crime No.66 of 2024, under sections 352, 325, 504, 506, 308 I.P.C. pending in the court of learned Additional Chief Judicial Magistrate, Deoband, Saharanpur, within stipulated period of time. 3. At the very outset, learned counsel for the petitioner submitted that the Investigating Officer has already submitted the charge-sheet on dated 24.03.2024, whereupon cognizance under section 190 Cr.P.C. has been taken up by learned court concerned on dated 25.04.2024, but the instant matter is pending at the behest of dilatory tactics adopted by respondent nos.2 to 5, which is still delaying in framing of charges; on account of the same, petitioner is suffering from irreparable loss. 4. Learned A.G.A. has no objection over the prayer as made by learned counsel for the petitioner. 5. Considering the arguments raised by learned counsel for the petitioner and without interfering into the merits of the matter, if there is no legal impediment, learned court concerned is hereby directed to proceed for framing of charges in the instant matter as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order, by way of affording proper opportunity of hearing to all concerns. 6. So far as expeditious disposal of the trial is concerned, this prayer will be available to the petitioner at relevant stage and time, if required. 7. The instant petition stands disposed of accordingly.
