Order 12/08/2025
1. The present writ petition has been filed on behalf of the petitioner against the order dated 21.05.2025 passed by the Rajasthan Civil Services Appellate Tribunal, Jaipur, in Appeal No.2597/2025, whereby the learned Tribunal has dismissed the appeal on the ground that the appeal is barred by time limitation.
2.
Learned counsel for the petitioner submits that the learned Tribunal erred in dismissing the appeal as time-barred while not considering the fact that the petitioner has sought a prayer and direction for the respondents to assign the correct confirmation service date and seniority of the petitioner.
3. Heard and considered the submissions made at the bar.
[2025:RJ-JP:31298] (2 of 2) [CW-11906/2025]
4. From bare perusal of the impugned order, it reveals that in the appeal, the petitioner has assailed the legality and correctness of the order dated 26.09.2017, which is also evident from prayer No.2 of the appeal memo filed before the learned Appellate Tribunal made by the petitioner, which is reproduced as under:-
"By an appropriate order or direction, direct the respondents to consider the pay fixation as per the similar situated persons and correct the order dated 26.09.2017 regarding the confirmation date 12.05.2017 in place of 12.08.2017 and service record may kindly be corrected as per this regard."
5. A bare look to the impugned order demonstrates that the petitioner herein has preferred the appeal against the order dated 26.09.2017 after taking due advantage of the same after lapse of seven years and six months and no explanation whatsoever for the alleged delay has been filed, therefore, the reason assigned by the learned Appellate Tribunal for dismissing the appeal on the ground of delay in absence of any sufficient cause cannot said to be perverse or arbitrary in any manner.
6. Accordingly, this Court finds no ground to interfere in the
order dated 21.05.2025 passed by the learned Appellate Tribunal (Annexure-9) in the absence of any sufficient cause; the learned Tribunal has rightly dismissed the appeal.
7. Accordingly, the present civil writ petition fails and is hereby dismissed.
8. All pending application(s), if any, shall stand disposed of.
