2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. It is submitted that none of the injuries sustained by the injured has been opined as dangerous to life. It is submitted that as per medical opinion, two injuries found on the non-vital part of the body have been opined as grievous in nature. It is contended that there are no criminal antecedents against the petitioners and trial will take considerable time in its conclusion. Counsel submits that petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose.
3. Per contra, learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by learned counsel for the petitioners.
4.
Learned counsel for the complainant submits that as many as 14 injuries have been found on the person of the injured out of which, two are grievous in nature.
5. I have considered the contentions.
6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially considering the nature of injuries and the fact that grievous injuries have been found on the non-vital part of the body of injured, as also considering the fact that there are no criminal antecedents against the petitioners and trial will take considerable time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application.
