This is an application under Section 483 of BNSS, 2023 for grant of bail of Page No.# 2/3 the accused/petitioner namely Surajit Nag in connection with Paltan Bazar PS Case No. 50/2025 registered under Sections 61(2)(b)/316(4) of BNS, 2023. 3. On 03.02.2025, complainant, namely; Navin Jain, S/o Lt. Suresh Chand Jain of Mega Roof Solutions lodged an FIR at Police Station stated that three individuals namely (1) Mr. Pranjal Das, (2) Mr. Surajit Nag, and (3) Mr. Ratan Ray, have allegedly conspired to divert complainants’ company fund. The company named as M/s Mega Roof Solutions, which is a leading roofing sheet manufacturer in Assam, and operates through authorized sales representatives. It is mentioned that one Mr. Pranjal Das, was appointed as a sales representative under the supervision of one Mr. Surajit Nag (General Manager- Sales), who was responsible for order procurement and payment collection. However, an outstanding amount of Rs. 36.5 lakhs was identified against sales handled by Mr. Pranjal Das. Upon investigation, it was found that payments were deposited into personal UPI accounts of Mr. Surajit Nag and Mr. Ratan Ray instead of the company’s official bank account, by violating company’s policy. Later Mr. Pranjal Das has provided bank statements confirming these transactions, while Mr. Surajt Nag and Mr. Ratan Ray deny their involvement. The company never authorized payments to personal accounts, thus indicating a clear case of fraud and criminal conspiracy. 4. It is submitted by the learned Addl. Public Prosecutor that charge-sheet vide CS No. 257/2025 dated 30.10.2025 has already been submitted and the petitioner has been behind bars for 57 days. Having regard to the period of detention and the fact of completion of investigation indicated by the submission of the the charge-sheet, further detention of the petitioners is not considered as necessary. More so, as the Bank accounts into which the company Page No.# 3/3 funds were deposited have already been frozen. 5. In view of above, the prayer for bail is allowed. He shall be released on bail of Rs. 50,000/- only with two sureties each of the like amount, subject to the satisfaction of CJM, Kamrup (M), Guwahati, Assam in connection with the aforesaid case. 6. It is further provided that the petitioner shall co-operate in the trial, if any and shall not try to influence or intimidate the witnesses in the case. 7.
