JUSTICE PRAVEER BHATNAGAR Order 08/09/2025 1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.245/2025, registered at Police Station Kalwar, District Jaipur [2025:RJ-JP:35943] (2 of 3) [CRLMB-9861/2025] (West), for the offence(s) under Sections 351(2), 115(2), 126(2), 324(4) and 309(4) of BNS. 2. Learned counsel for the petitioners submit that the accused- petitioners have falsely been implicated in this case. It is contended that co-accused Karan Singh has already been enlarged on bail by the trial Court and the case of the present petitioners are akin to the co-accused Karan Singh. It is also contended that the accused-petitioners are in custody since 09.07.2025 and the charge-sheet has already been submitted. It is further contended that the injury sustained to injured Arjun is simple in nature and the trial of the case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail applications. It is contended that the petitioners are habitual offenders and against whom seven cases have been registered under various offences, which are still pending trial, therefore, considering the above facts, the bail applications of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. Considering the facts that the co-accused Karan Singh has already been enlarged on bail by the trial Court itself, the case of the present petitioners are not distinguishable from the other co- accused, this Court deems it proper to enlarge the accused- petitioners on bail. 6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused petitioners [2025:RJ-JP:35943] (3 of 3) [CRLMB-9861/2025] namely; 1. Bhupendra Singh @ Bhupi S/o Sh. Karan Singh and 2. Narender Singh @ Nandu S/o Sh. Om Prakash, in connection with FIR No.245/2025, registered at Police Station Kalwar, District Jaipur (West), shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so. 7. The accused-petitioners are also directed to mark their presence on 25th of every month before the concerned Police Station till conclusion of the trial. The SHO of the concerned Police Station is directed to maintain a regular register marking the presence of the accused-petitioners and shall send the presence report of the accused-petitioners on the same day to the concerned trial Court every month without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioners for cancellation of their bails before the concerned Court.
