JUSTICE NARENDRA SINGH DHADDHA Order 30/06/2025 Learned counsel for the petitioner submits that complainant- Mr. Abhishek Jef was Collection Manager in M/s Cholamandalam Investment & Finance Company and he lodged an FIR No.0537/2021 at Police Station Neem Ka Thana, District Sikar for the offence under Sections 341, 323, 382 IPC and Sections 3(2) (va), 3(2)(v), 3(1)(r), 3(1)(s) of SC & ST (Prevention of Atrocities) Act, 1989 regarding money which was taken by Mr. Vikas Kulhari. After that Vikas Kulhari filed a criminal miscellaneous petition No.2765/2022, in which a compromise was arrived at between him and Mr. Abhishek Jef. [2025:RJ-JP:23883] (2 of 2) [CRLMA-308/2022] Learned counsel for the petitioner-M/s Cholamandalam Investment & Finance Company further submits that Mr. Vikas Kulhari had no right to enter into compromise on behalf of M/s Cholamandalam Investment & Finance Company. So, order dated 04.04.2022 passed by this Court in S.B. Criminal Miscellaneous Petition No.2765/2022 be recalled. Learned Additional Government Advocate has submitted the factual report. Looking to the facts and circumstances of the case, the order dated 04.04.2022 passed by this Court is recalled and Investigating Officer is directed to investigate the matter as per report dated 26.11.2021 submitted by Branch Manager M/s Cholamandalam Investment & Finance Company. Without being prejudiced by the order dated 04.04.2022 passed by this Court. The present application is disposed of accordingly. Pending application(s), if any, stands, disposed of.
