Page No.# 2/3 BEFORE HONOURABLE MRS. JUSTICE SHAMIMA JAHAN ORDER 29.10.2025 Heard Mr. R. K. Nath, learned counsel for the applicant and Mr. B. Sharma, learned Additional Public Prosecutor for the opposite party No. 1. By this application under Section 430 of the BNSS, 2023, the applicant has prayed for suspension of sentence, dated 29.10.2020, passed by the learned Additional Sessions Judge, No. 2, Kamrup (M), Assam, in Criminal Appeal No. 155/2019. The applicant has also prayed for subsequent bail to be granted to him during the pendency of the said revision petition. It is noticed that the applicant has been awarded with the punishment of S.I. for 6 months, along with the compensation amount and with the default clause, and it is stated by the learned counsel appearing for the applicant that the applicant had surrendered before the learned Trial Court and has been inside the jail for 4 months. In the interest of justice, it is as such directed that the sentence inflicted upon the applicant be suspended, during the pendency of the revision petition and the applicant be released on subsequent bail, on furnishing of a bail bond of Rs. 20,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court.
