Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the state respondent. 2. By invoking the provisions of Section 482 of the BNSS, 2023 the accused- petitioners, namely, 1. Nasir Uddin Ahmed and 2. Rakibul Hussain are seeking Page No.# 2/3 anticipatory bail in connection with Uluani P.S. Case Mo.55/2025 registered under Sections 61(2)/318(4)/316(2)/336(4)/3(5) of BNS, 2023. 3. The FIR dated 15.09.2025 names five accused persons including petitioner No. 1. The gist of the allegations is that the accused persons obtained Adhaar Cards of several persons and using them they took out numerous SIM Cards, some of which are suspected to be used in illegal activities. 4. The case diary has been received. 5. The learned Addl. P.P. fairly submits that the petitioner No. 1 is stated to be an associate of petitioner No. 2, but there is no recovery of any incriminating materials so far from the petitioner No.1. However, though the petitioner No. 2 is not named in the FIR, there are significant incriminating materials against him and also 41 numbers of SIM Cards, finger prints, scanners etc. were recovered from him. Investigation is going on. 6. In the given facts and circumstances, the anticipatory bail application with regard to petitioner No. 2, namely, Rakibul Hussain, stands rejected. 7. However, with regard to petitioner No. 1, namely, Nasir Uddin Ahmed, it is hereby directed that in the event of arrest of the petitioner No. 1, namely, Nasir Uddin Ahmed in connection with Uluani P.S. Case Mo.55/2025, he shall be allowed to go on bail of ₹25,000/- with one surety of the like amount to the satisfaction of the arresting authority, subject to the following suitable conditions :- (a) He shall co-operate with the remaining investigation; (b) He shall not hamper or tamper with evidence; (c) He shall not indulge in illegal activities ; Page No.# 3/3 Violation of the conditions will entail cancellation of bail. 8.
