1. Heard Mr. S. Kakati, learned counsel for the petitioner and also heard Mr. D. P. Goswami, learned Addl. P.P for the State.
2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Girish Chand Singh, who was arrested on 01.11.2025 in connection with Kamakhya G.R.P.S Case No. 160/2025 under Sections 61(2)/318(4)/62 of BNS.

3. The allegation against the petitioner as reflected in the FIR that he was found in possession of fake gold metal weighing 8.68 grams and accordingly he was arrested on suspicion of being a member of fake gold racket and that he was carrying the same in order to dupe innocent people by presenting the same as pure gold.
4. A perusal of the FIR show that no actual act as apprehended by the arresting authority has been committed by the petitioner. Possession of the metal whether real or fake gold by itself is not an offence in the absence of other materials. The petitioner was arrested on 01.11.2025 and therefore has spent 11 days in custody and by now his interrogation also been over.
5. In view of the aforesaid case, the prayer for bail is allowed.
6. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- (Rupees Fifty Thousand) with one surety of like amount to the satisfaction of learned CJM, Kamrup(M) in connection with the aforesaid case subject to the following condition-
7. The direction for bail is further subject to the conditions: (a) That the accused person shall be available for remaining trial; (b) That the accused persons shall not hamper or tamper with evidence.
8. Accordingly, the bail petition is disposed of.
